PREVENTION OF CRUELTY

GREEN MERCY has been actively involved in prevention of Cruelty, Campaigning for change, Protection of Animal Rights and implementation of existing Animal Welfare Laws for the Last two Decades. We took part in the Drive to Ban Wild Animals in the Circus, live animals in dissection, hunting of seals, whales and dolphins and in objecting cruelty to Animals in films and performing Street Shows with monkeys and bears. Cruelty to Animals is growing more and more rampant. Be it shown on TV Programs, in cinema or at local poultry farms, Diary Farms, Horse Farms, Slaughter Houses, during Transportation and even on pets, the incidence of cruelty has grown alarmingly. Our efforts extended to counseling, confiscation of Animals, booking FIRs, going to Court, speaking with authorities and writing awareness columns for the Print Media and Electronic Media. In all 306 Animals were reported on Various Occasions, the reports were investigated whenever possible and the abused Animals were Rescued. We Try to Conduct Cruelty Raids on Wild Life Poachers at lease once in a month. 1 Barking deer, 1 Sloth Bear, 1 Hyena and 10 Monitor Lizards were seized and sent to the Zoo Park at Vizag.

LEGAL FRAME WORK


Laws, Acts and legal provisions arsenal with which animal actvists fight their wars. It is vitally necessary that one is familiar with the existing laws and Acts relevant to our cause.

These may be divided into Central and State Government Legislations :-

1. Central Government:


1) Constitution of India:- Our constitution, the supreme law of all laws, also mentions animals and the environment. However, it is mentioned only in three places, and all are, unfortunately, non-justiciable which means that they are not actually enforceable in a Court of Law.
a) Part IV, Articles 48, 48-A in the Directive Principles.

b) Part IV, Article 51 A(g) in the Fundamental Duties.

2) Indian Penal Code (Act no.: 45 of (1860)
This is our code of penalties or punishments for those who break the laws. Relevant Sections are:
a) Section 428

b) Section 429

3) Code of Criminal procedure (Act No: 2 of 1974)

This is the code for procedures to be followe when crimes have been committed (for eg how to make a police complaint) Relevant Sections are:

a) Chapter V, Sections 41, 43

b) Chapter XI, Section 149, 156

4) Prevention of Cruelty to Animals Act (No: 59 of 1960)

This is the main Act which covers the protection of animals and prevention of cruelty. Relevant Sections are:

a) Chapter III, Section 11

b) Chapter V, Section 22

5) Wildlife Protection Act (No: 53 of 1972)

This is the main Act relating to the protection of wild animals, birds and plants. Relevant articles are:

a) Chapter III, Section 9

b) Chapter IV: Section 29, 31, 38-J

c) Chapter V: Section 39, 44

6) Other important Rules and Laws (Central)
a) Rules for the control and supervision of experiments of Animals

b) Rules to prevent cruelty to animals during Rail Transport

c) Rules for transportation of Animals by air

d) Cinematograph Act, 1952, which lays down rules for the use of animals during film shooting.

e) I.S.I. Standards for housing of animals

f) Convention or international trade in endangered species of wild flora and famna, 1975 (CITES)

2. Andhra Pradesh State Government :

Andhra Pradesh Birds and Animals Sacrifies Prohibition Act of 1950. This is the main law against Animal Sacrifice in A.P. Relevent sections are III, IV, V and VIII

Andhra Pradesh High Court Judgement Against OX Races(5.12.1989) As per this Judgement, OX racing is banned throughout the state of Andhra Pradesh.

Andhra Pradesh Prohibition of cow slaughter and Animal Preservation Act (No: 11 of 1977) This act prohibits cow slaughter in Andhra Prdesh which extends particularly to cows. claves of cows. calves of she buffalo, and to the preservation of milch cattle and draught animals. Relevant Articles are 5 and 8

Andhra Pradesh Towns Nuisance Act of 1889 Among numerous provisions relating to town administration. it also prohibits the abuse of infliction of unnecessary suffering or animals. Relevant Sections is Section 5

Remember : All the offences mentioned are classed as cognizable offences and therefore deserving of recognition as per section 154 of the code of Criminal procedure, which makes it mandatory a police officer to take down in writing a complaint from an informant.

PERAMBLE

Whereas all animals have rights,

Whereas disregard and contempt of the rights of animals have resulted and continue to result in crimes by man against nature and against animals.

Whereas recognition by the human species of the right to existance of other animal species is the foundation of the co-existence of species throughout the world.

Whereas genocide has been perpetrated by man on animals and the threat of genocide, continues.

Whereas respect for animals is linked to the respect of man for man.

Whereas from childhood man should be taught to observe, understand, respect and love animals.

Article 1 : All animals are born with an equal claim on life and the same rights to existence.

Article 2 :

(1) All animals are entitled to respect

(2) Man as an animal species shall not arrogate to himself the right to exterminate or inhumanly exploit other animals. It is his duty to use his knowledge for the welfare of animals.

(3) All animal have the right to the attention, care and protection of men.

Article 3 : No animals shall be ill treated or be subjected to curel acts.

Article 4 : All wild animals have the right to liberty in their natural environment, whether land, air or water.

Article 5 :

(1) Animals of species living traditionally in a human enviroment have the right to live and grow at the rythum and under the conditions of life and freedom peculiar to their species.

(2) Any interference by man with this rhythm or these conditions for purpose of gain is an infringement of their right.

Article 6 :

(1) All companion animals have the right to complete their natural life span.

(2) Abondment of an animal is a cruel and degrading act.

Article 7 :

All working animals are entitled to a reasonable limitation of the duration and intensity of their work to the necessary nourishment and to rest.

Article 8 :

(1) Animal experimentation involving physical or psycho-ogical suffering is in compatible with the rights of ani- mals, whether it be for scientific, medical, commercial or any other form of research.

(2) Replacement methods must be used and developed. Alternative to animal experimentation should be pre-pared.

Article 9 :

(1) No animal shall be exploited for the amusement of man

(2) Exhibitions and spectacles involving naimals are compatible with their dignity.

Article 10 : Any act involving slaughtering of the animlas is biocide, that is, a crime aganist the life.

Article 11 :

(1) Any at involving mass killing of wild animals is genocide, that is, a crime against the species.

(2) Pollution or destruction of the natural environment leads to genocide.

Article 12 :

(1) Dead animals shall be treated with respect.

(2) Scenes of violence involving animals shall be banned from cinema and television except for human education.

Article  13 :

(1) Representatives of movements that defend animal rights should have an effects voice at all levels of government.

(2) The rights of anumals, like human rights should enjoy the protection of law.
